Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Scott Fryxell, doing business as Realness ("Realness," "we," "us"), a sole proprietorship based in California, USA. They govern your use of the hosted service at realness.online (the "Service"). The Realness software itself is also covered by the separate source-available license; these Terms govern use of the hosted Service, not the source code.

By creating an account, verifying a phone number, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use Realness

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Service you represent that you meet these requirements and that you are not barred from using it under the laws of your jurisdiction.

2. What the Service does

Realness turns a photo into a vector poster. The conversion happens on your device; the original source photo is processed locally and is not uploaded to or stored by us. What you choose to publish — your posters, statements, and profile — is stored so the Service can display it. The Service also includes a shared feed ("Thoughts") and a phone-based identity so people can find one another. We may add, change, or remove features over time.

3. Your account and phone number

Identity on Realness is derived from your mobile phone number. When you sign in, we send a one-time code to confirm you control that number. You are responsible for keeping access to your number and account secure, and for everything done through your account. Because your identity is derived from your phone number, changing numbers may affect your access to content you created; see the Privacy Policy for how this affects deletion and export.

4. Acceptable use

You agree not to use the Service to:

• post, store, or share content that is illegal, infringing, or that you do not have the right to share;
• harass, threaten, impersonate, or violate the privacy or rights of others;
• upload sexual content involving minors, or any content that exploits or endangers a child;
• distribute malware, attempt to breach or overload the Service, or interfere with others' use of it;
• scrape, resell, or systematically extract the Service except as the source-available license allows.

Each instance of Realness has exactly one human moderator who is responsible for content within it. On the hosted Service that moderator is us, and we may review, remove, or restrict content and may suspend or terminate accounts that violate these Terms — at our discretion and without notice where the law or the safety of others requires it.

5. Your content

You keep ownership of the content you create and publish through the Service, including the posters and other outputs you make ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service (for example, showing your poster in the shared feed). This license ends when you delete the content or your account, except for copies retained in routine backups for a limited period or as required by law.

You represent that you have the rights necessary to post Your Content and that it does not infringe anyone else's rights. You are responsible for Your Content. You own the outputs you create with Realness and may use them in personal, client, and commercial work under all pricing tiers, including the free tier.

6. Licensing for teams and organizations

Personal use of the hosted Service is free. If your team, studio, family circle, company, or institution needs a formal license agreement — for procurement, legal compliance, or to support the project — we offer commercial tiers on the Pricing page (currently "Small teams" at $100/year and "Large organizations" at $500/year).

An organization that licenses or self-hosts Realness is the responsible operator of its instance: it acts as the moderator (or appoints one), is responsible for its members' content and conduct, and is responsible for complying with the laws that apply to the community it runs. Responsibility for a self-hosted instance transfers to the organization that operates it, as described in the source-available license. Organizations agree to indemnify us as described in Section 11 for claims arising out of the instances and communities they operate.

7. Payments, renewal, and refunds

Paid licenses are billed annually in advance and renew automatically each year unless cancelled before the renewal date. You can cancel at any time; cancellation stops the next renewal and does not retroactively refund the current term, except as stated here. You may request a full refund within 14 days of a new or renewing charge by contacting us. Prices are exclusive of taxes; you are responsible for any sales tax, VAT, or similar taxes that apply to your purchase. We may change prices on a going-forward basis, with notice before your next renewal.

8. Intellectual property

The "Realness" name, logo, and brand are ours and are not licensed to you by these Terms or by the source-available license. The Realness software is made available under its separate license; nothing here grants you rights in the software beyond that license. Except for Your Content, all rights in the Service are reserved to us.

9. Copyright and DMCA

We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a notice with the information the DMCA requires (identification of the work, the infringing material and its location, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act) to our designated agent at security@realness.online. We may remove allegedly infringing content and terminate repeat infringers. If your content was removed in error, you may submit a counter-notice to the same address.

10. Third-party services

The Service relies on third-party providers to function, including Google Firebase (authentication, storage, and hosting) and Google reCAPTCHA (abuse prevention at sign-in). Your use of the Service is also subject to those providers' terms. We describe what they process in our Privacy Policy. We are not responsible for third-party services we do not control.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of another. Organizations that license or self-host Realness agree to do the same for claims arising out of the instances and communities they operate and their members' content and conduct.

13. Suspension and termination

You may stop using the Service at any time and may delete your account. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other people. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — survive.

14. Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. If we make a material change, we will take reasonable steps to let you know. Your continued use of the Service after a change takes effect means you accept the updated Terms.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us about the hosted Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Service.

Privacy Policy

This Privacy Policy explains what Realness collects, why, and what you can do about it. Realness is operated by Scott Fryxell, doing business as Realness ("Realness," "we," "us"), a sole proprietorship in California, USA. It applies to the hosted service at realness.online (the "Service") and works alongside our Terms of Service.

The short version

Realness is built to collect as little about you as possible. The original photo you start from never leaves your device — it is turned into a vector poster locally, and only what you choose to publish is stored. We do not sell your data, we do not run advertising, and we do not track you across the web.

What we collect

• Your mobile phone number. Your identity on Realness is derived from your phone number. We use it to verify that you are a real person and to let people find one another. Verification is done by sending a one-time code.
• Your profile. The name you choose and any profile details you add.
• Content you publish. The posters, statements, and other content you choose to create and share through the Service.
• Limited technical data. Basic information needed to operate and secure the Service, such as request and error logs handled by our hosting provider.
• Anti-abuse signals. When you sign in, Google reCAPTCHA collects device and interaction signals to tell humans from bots.

What we do not collect

• Your source photos. The image you start from is processed on your device and is not uploaded to or stored by us.
• Advertising or cross-site tracking. We don't use advertising cookies or sell or share your data with data brokers.

How we use what we collect

We use the information above to provide and operate the Service, verify and secure accounts, prevent fraud and abuse, moderate content, respond to you, and comply with the law. We do not use it for advertising.

Phone-number-derived identity

Because your identity and the content you create are keyed to an identifier derived from your phone number, that number is central to how the Service works. This has two practical effects you should know about:

• Export of your content is tied to your verified number.
• Deletion of your account removes the data keyed to your identity, but if you change phone numbers, content created under the old number may become inaccessible to you. Contact us if you need help linking or removing data across numbers.

Service providers (sub-processors)

We rely on a small number of providers to run the Service. They process data on our behalf under their own terms:

• Google Firebase — authentication, file storage, and hosting. Data is stored on Google Cloud infrastructure, primarily in the United States.
• Google reCAPTCHA — bot and abuse prevention at sign-in.

We may add or change providers as the Service evolves and will update this list when we do.

When we share information

We do not sell your personal information. We may disclose information only when necessary to: operate the Service through the providers above; comply with a law, regulation, or valid legal process; enforce our Terms; or protect the rights, safety, and security of our users, the public, or us.

Storage on your device

Realness stores data locally on your device — for example in your browser's local storage and IndexedDB — so the app works well and keeps your work-in- progress with you. Google reCAPTCHA may set cookies necessary for abuse prevention. We don't use cookies for advertising.

Children

The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has given us personal information, contact us and we will delete it. Users under 18 must use the Service with a parent or guardian's involvement.

Your rights and choices

You can request to access, export, or delete your personal information by contacting us at security@realness.online. We will verify your request using your phone number, since identity on Realness is phone-derived.

If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives you the right to know what personal information we collect, to request deletion, to correct inaccurate information, and not to be discriminated against for exercising these rights. We do not sell or "share" personal information as those terms are defined under California law. To exercise any of these rights, contact us at the address above.

Data retention

We keep personal information only as long as needed to provide the Service and for legitimate legal, security, and operational purposes. When you delete your account, we remove the data keyed to your identity, except for limited copies retained in routine backups for a short period or where the law requires us to keep them.

Security

We use reasonable measures, including our providers' security controls, to protect your information. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security. If you have a security concern, contact security@realness.online.

International users

The Service is operated from the United States and relies on U.S.-based infrastructure. If you use it from outside the United States, you understand that your information will be processed in the United States.

Changes to this policy

We may update this Privacy Policy. If we make a material change, we will take reasonable steps to let you know. The "last updated" date above shows when it last changed.
